Florida Senate - 2012 SB 1430 By Senator Detert 23-01320-12 20121430__ 1 A bill to be entitled 2 An act relating to basins; amending s. 373.0693, F.S.; 3 repealing provisions relating to the formation and 4 designation of the Manasota Basin; repealing 5 provisions relating to the termination of the Oklawaha 6 River Basin and the Greater St. Johns River Basin; 7 providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsections (9) and (10) of section 373.0693, 12 Florida Statutes, are renumbered as subsections (7) and (8), 13 respectively, and present subsections (7) and (8) of that 14 section are amended to read: 15 373.0693 Basins; basin boards.— 16(7) At 11:59 p.m. on December 31, 1976, the Manasota17Watershed Basin of the Ridge and Lower Gulf Coast Water18Management District, which is annexed to the Southwest Florida19Water Management District by change of its boundaries pursuant20to chapter 76-243, Laws of Florida, shall be formed into a21subdistrict or basin of the Southwest Florida Water Management22District, subject to the same provisions as the other basins in23such district. Such subdistrict shall be designated initially as24the Manasota Basin. The members of the governing board of the25Manasota Watershed Basin of the Ridge and Lower Gulf Coast Water26Management District shall become members of the governing board27of the Manasota Basin of the Southwest Florida Water Management28District. Notwithstanding other provisions in this section,29beginning on July 1, 2001, the membership of the Manasota Basin30Board shall be comprised of two members from Manatee County and31two members from Sarasota County. Matters relating to tie votes32shall be resolved pursuant to subsection (6) by the chair33designated by the governing board to vote in case of a tie vote.34(8)(a) At 11:59 p.m. on June 30, 1988, the area transferred35from the Southwest Florida Water Management District to the St.36Johns River Water Management District by change of boundaries37pursuant to chapter 76-243, Laws of Florida, shall cease to be a38subdistrict or basin of the St. Johns River Water Management39District known as the Oklawaha River Basin and said Oklawaha40River Basin shall cease to exist. However, any recognition of an41Oklawaha River Basin or an Oklawaha River Hydrologic Basin for42regulatory purposes shall be unaffected. The area formerly known43as the Oklawaha River Basin shall continue to be part of the St.44Johns River Water Management District.45(b) Also, the entire area of the St. Johns River Water46Management District, less those areas formerly in the Oklawaha47Basin, shall cease to be a subdistrict or basin of the St. Johns48River Water Management District known as the Greater St. Johns49River Basin and said Greater St. Johns River Basin shall cease50to exist. The area formerly known as the Greater St. Johns River51Basin shall continue to be part of the St. Johns River Water52Management District.53(c) As of 11:59 p.m. on June 30, 1988, assets and54liabilities of the former Oklawaha River and Greater St. Johns55River Basins shall be assets and liabilities of the St. Johns56River Water Management District. Any contracts, plans, orders,57or agreements of such basins shall continue to be in effect, but58may be modified or repealed by the St. Johns River Water59Management District in accordance with law. For all purposes for60assessing and levying the millage rate authorized under s.61373.503, subsequent to December 31, 1987, including the purposes62of certifying the millage rate for fiscal year 1988-1989,63pursuant to chapter 200, said millage rate shall be levied64retroactive to January 1, 1988.65 Section 2. This act shall take effect July 1, 2012.
