Florida Senate - 2017 CS for SB 1438 By the Committee on Environmental Preservation and Conservation; and Senator Broxson 592-03013-17 20171438c1 1 A bill to be entitled 2 An act relating to aquifer replenishment; amending s. 3 403.087, F.S.; authorizing the Department of 4 Environmental Protection to include certain additional 5 conditions on permits issued for projects that involve 6 underground injection of reclaimed water or other 7 water resources; providing applicability; creating s. 8 403.0878, F.S.; authorizing the department to adopt 9 rules establishing voluntary facility classifications 10 and associated operator licensing requirements for 11 certain water treatment facilities; providing an 12 effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Subsection (4) of section 403.087, Florida 17 Statutes, is amended to read: 18 403.087 Permits; general issuance; denial; revocation; 19 prohibition; penalty.— 20 (4) The department shall issue permits on such conditions 21 as are necessary to effect the intent and purposes of this 22 section. For projects that propose underground injection of 23 reclaimed water or other water resources intended to protect, 24 augment, or replenish the state’s groundwater resources, the 25 department may include conditions, such as the establishment of 26 a zone of discharge for groundwater standards, and any 27 associated institutional controls within the area, such as 28 property interests, use restrictions and access controls, and 29 well construction limitations. This subsection does not apply to 30 those natural processes that introduce surface or stormwater 31 into groundwater resources. 32 Section 2. Section 403.0878, Florida Statutes, is created 33 to read: 34 403.0878 Classifications for sustainable water resources. 35 The Legislature recognizes that communities are providing 36 treatment for reclaimed water, stormwater, and other water 37 resources as a means of promoting the availability of sufficient 38 water for existing and future reasonable-beneficial uses and 39 natural systems in accordance with chapter 373. The department 40 may adopt rules establishing voluntary facility classifications 41 and associated operator licensing requirements for such 42 treatment facilities. 43 Section 3. This act shall take effect July 1, 2017. 44
