Florida Senate - 2021 SB 1460 By Senator Brandes 24-01383A-21 20211460__ 1 A bill to be entitled 2 An act relating to chiropractic medicine; amending s. 3 460.403, F.S.; revising the definition of the term 4 “practice of chiropractic medicine” to authorize 5 chiropractic physicians to prescribe, order, store, 6 and administer medical oxygen and articles of natural 7 origin if they complete specified training; amending 8 s. 460.408, F.S.; deleting a requirement that 9 continuing chiropractic education be completed in a 10 classroom setting; authorizing licensees to complete 11 all required continuing education in an online format; 12 providing requirements for online continuing education 13 courses; creating s. 465.036, F.S.; authorizing 14 pharmacists to dispense articles of natural origin 15 pursuant to an order from a licensed chiropractic 16 physician; defining the term “articles of natural 17 origin”; providing an effective date. 18 19 Be It Enacted by the Legislature of the State of Florida: 20 21 Section 1. Paragraph (c) of subsection (9) of section 22 460.403, Florida Statutes, is amended to read: 23 460.403 Definitions.—As used in this chapter, the term: 24 (9) 25 (c)1. Chiropractic physicians may adjust, manipulate, or 26 treat the human body by manual, mechanical, electrical, or 27 natural methods; by the use of physical means or physiotherapy, 28 including light, heat, water, or exercise; by the use of 29 acupuncture; or by the administration of foods, food 30 concentrates, food extracts, and items for which a prescription 31 is not required and may apply first aid and hygiene, but 32 chiropractic physicians are expressly prohibited from 33 prescribing or administering to any person any legend drug 34 except as authorized under subparagraphs 2. and 3.subparagraph352., from performing any surgery except as stated herein, or from 36 practicing obstetrics. 37 2. Notwithstanding the prohibition against prescribing and 38 administering legend drugs under subparagraph 1. or s. 39 499.83(2)(c), pursuant to board rule, chiropractic physicians 40 who have completed a board-approved, 36-hour training course on 41 articles of natural origin and administration of medical oxygen 42 may prescribe, order, store, and administer, for emergency43purposes only at the chiropractic physician’s office or place of44business,prescription medical oxygen and articles of natural 45 origin, including vitamins, minerals, amino acids, fatty acids, 46 hyaluronic acid, enzymes, saline, antioxidants, dextrose, 47 glandular-based products, cellular components, extracts, water, 48 botanicals, phytonutrients, and homeopathic products. 49 3. Notwithstanding the prohibition against prescribing and 50 administering legend drugs under subparagraph 1. or s. 51 499.83(2)(c), chiropractic physiciansandmayalsoorder, store, 52 and administer the following topical anesthetics in aerosol 53 form: 54 a. Any solution consisting of 25 percent ethylchloride and 55 75 percent dichlorodifluoromethane. 56 b. Any solution consisting of 15 percent 57 dichlorodifluoromethane and 85 percent 58 trichloromonofluoromethane. 59 60However, this paragraph does not authorize a chiropractic61physician to prescribe medical oxygen as defined in chapter 499.62 Section 2. Subsection (1) of section 460.408, Florida 63 Statutes, is amended to read: 64 460.408 Continuing chiropractic education.— 65 (1) The board shall require licensees to periodically 66 demonstrate their professional competence as a condition of 67 renewal of a license by completing up to 40contact classroom68 hours of continuing education. 69 (a) Continuing education courses sponsored by chiropractic 70 colleges whose graduates are eligible for examination under any 71 provision of this chapter may be approved upon review by the 72 board if all other requirements of board rules setting forth 73 criteria for course approval are met. 74 (b) The board shall approve those courses that build upon 75 the basic courses required for the practice of chiropractic 76 medicine, and the board may also approve courses in adjunctive 77 modalities. Courses that consist of instruction in the use, 78 application, prescription, recommendation, or administration of 79 a specific company’s brand of products or services are not 80 eligible for approval. 81 (c) All 40 hours of continuing education may be completed 82 in an online format. Continuing education courses offered online 83 must be competency-based and incorporate the Shareable Content 84 Object Reference Model standards for web-based electronic 85 educational learning established by the federal Advanced 86 Distributed Learning Initiative or more stringent standards as 87 determined by the board. 88 Section 3. Section 465.036, Florida Statutes, is created to 89 read: 90 465.036 Dispensing orders for articles of natural origin. 91 Notwithstanding any other law, a pharmacist may dispense 92 articles of natural origin pursuant to an order from a 93 chiropractic physician licensed under chapter 460. For purposes 94 of this section, the term “articles of natural origin” includes 95 vitamins, minerals, amino acids, fatty acids, hyaluronic acid, 96 enzymes, saline, antioxidants, dextrose, glandular-based 97 products, cellular components, extracts, water, botanicals, 98 phytonutrients, and homeopathic products. 99 Section 4. This act shall take effect upon becoming a law.
