ENROLLED 2010 Legislature CS for SB 1514, 1st Engrossed 20101514er 1 2 An act relating to recreational licenses; amending ss. 3 379.3511 and 379.352, F.S.; exempting the shoreline 4 fishing license from a charge imposed to compensate 5 the subagent or tax collector issuing the license; 6 authorizing the subagent or tax collector to retain a 7 portion of certain other license proceeds; amending s. 8 379.354, F.S.; removing the fee for an annual resident 9 shoreline fishing license; providing an effective 10 date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Paragraph (e) of subsection (1) of section 15 379.3511, Florida Statutes, is amended to read: 16 379.3511 Appointment of subagents for the sale of hunting, 17 fishing, and trapping licenses and permits.— 18 (1) Subagents shall serve at the pleasure of the 19 commission. The commission may establish, by rule, procedures 20 for the selection and appointment of subagents. The following 21 are requirements for subagents so appointed: 22 (e) A subagent may charge and receive as his or her 23 compensation 50 cents for each license or permit sold. This 24 charge is in addition to the sum required by law to be collected 25 for the sale and issuance of each license or permit. This charge 26 does not apply to the shoreline fishing license; however, for 27 each shoreline fishing license issued, the subagent may retain 28 50 cents from other license proceeds otherwise due the 29 commission. 30 Section 2. Subsection (5) of section 379.352, Florida 31 Statutes, is amended to read: 32 379.352 Recreational licenses, permits, and authorization 33 numbers to take wild animal life, freshwater aquatic life, and 34 marine life; issuance; costs; reporting.— 35 (5) In addition to any license or permit fee, the sum of 36 $1.50 shall be charged for each license or management area 37 permit, except for replacement licenses, to cover the cost of 38 issuing such license or permit. This charge does not apply to 39 the shoreline fishing license; however, for each shoreline 40 fishing license issued, the tax collector may retain 50 cents 41 from other license proceeds otherwise due the commission. 42 Section 3. Paragraph (k) of subsection (4) of section 43 379.354, Florida Statutes, is amended to read: 44 379.354 Recreational licenses, permits, and authorization 45 numbers; fees established.— 46 (4) RESIDENT HUNTING AND FISHING LICENSES.—The licenses and 47 fees for residents participating in hunting and fishing 48 activities in this state are as follows: 49 (k)Annual resident shoreline fishing license, $7.50.An 50Theannual resident shoreline fishing license shall be issued 51 without a fee to allowallowsany resident to saltwater fish 52 from land or from a structure fixed to the land. This license is 53 not required for any resident issued any other license 54 identified in this section whichthatallows the taking of 55 saltwater fish. 56 Section 4. This act shall take effect July 1, 2010.
