Florida Senate - 2012 SB 1530 By Senator Siplin 19-01277-12 20121530__ 1 A bill to be entitled 2 An act relating to instructional materials for public 3 school education; amending s. 1006.282, F.S.; 4 correcting a cross-reference; amending ss. 1006.37 and 5 1006.38, F.S.; revising the period of time for the 6 requisition and maintenance of inventory of 7 instructional materials for certain core courses; 8 amending s. 1006.40, F.S.; revising the period of time 9 for the purchase of instructional materials for 10 certain core courses; revising requirements relating 11 to the use of the instructional materials allocation 12 for the purchase of materials not on the state-adopted 13 list; providing an effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. Subsection (3) of section 1006.282, Florida 18 Statutes, is amended to read: 19 1006.282 Pilot program for the transition to electronic and 20 digital instructional materials.— 21 (3) A school designated as a pilot program school by the 22 school board is exempt from: 23 (a) Section 1006.40(3)(a)1006.40(2)(a), if the school 24 provides comprehensive electronic or digital instructional 25 materials to all students; and 26 (b) Section 1006.37. 27 Section 2. Subsection (1) of section 1006.37, Florida 28 Statutes, is amended to read: 29 1006.37 Requisition of instructional materials from 30 publisher’s depository.— 31 (1) The district school superintendent shall requisition 32 adopted instructional materials from the depository of the 33 publisher with whom a contract has been made. However, the 34 superintendent shall requisition current instructional materials 35 to provide each student with a textbook or other materials as a 36 major tool of instruction in core courses of the subject areas 37 specified in s. 1006.40(2). These materials must be 38 requisitioned within the first 42years of the adoption cycle, 39 except for instructional materials related to growth of student 40 membership or instructional materials maintenance needs. The 41 superintendent may requisition instructional materials in the 42 core subject areas specified in s. 1006.40(2) that are related 43 to growth of student membership or instructional materials 44 maintenance needs during the3rd, 4th,5th year, and 6th years45 of the original contract period. 46 Section 3. Subsections (12) and (13) of section 1006.38, 47 Florida Statutes, are amended to read: 48 1006.38 Duties, responsibilities, and requirements of 49 instructional materials publishers and manufacturers.—Publishers 50 and manufacturers of instructional materials, or their 51 representatives, shall: 52 (12) For the core subject areas specified in s. 1006.40(2), 53 maintain in the depository for the first 42years of the 54 contract an inventory of instructional materials sufficient to 55 receive and fill orders. 56 (13) For the core subject areas specified in s. 1006.40(2), 57 ensure the availability of an inventory sufficient to receive 58 and fill orders for instructional materials for growth, 59 including the opening of a new school, and replacement during 60 the 5th year3rd and subsequent yearsof the original contract 61 period. 62 Section 4. Subsections (2) and (4) of section 1006.40, 63 Florida Statutes, are amended to read: 64 1006.40 Use of instructional materials allocation; 65 instructional materials, library books, and reference books; 66 repair of books.— 67 (2) Each district school board must purchase current 68 instructional materials to provide each student with a major 69 tool of instruction in core courses of the subject areas of 70 mathematics, language arts, science, social studies, reading, 71 and literature for kindergarten through grade 12. Such purchase 72 must be made within the first 42years after the effective date 73 of the adoption cycle. 74 (4) The funds described in subsection (3) which district 75 school boards may use to purchase materials not on the state 76 adopted list shall be used for the purchase of instructional 77 materials or other items having intellectual content that is 78 aligned to the Next Generation Sunshine State Standards. These 79 instructional materials or other items shall be used instead of 80 instructional materials on the state-adopted list which provide 81 instruction in the core courses pursuant to subsection (2)which82assist in the instruction of a subject or course. These 83 instructional materials or other items may be available in 84 bound, unbound, kit, or package form and may consist of 85 hardbacked or softbacked textbooks, electronic content, 86 replacements for items which were part of previously purchased 87 instructional materials, consumables, learning laboratories, 88 manipulatives, electronic media, computer courseware or 89 software, and other commonly accepted instructional tools as 90 prescribed by district school board rule. 91 Section 5. This act shall take effect July 1, 2012.
