1                        A bill to be entitled 
2         An act relating to veterans’ guardianship; amending s. 
3         744.604, F.S.; revising the definition of the term 
4         “benefits” for purposes of the Veterans’ Guardianship 
5         Law; providing an effective date.

7  Be It Enacted by the Legislature of the State of Florida: 
8 
9         Section 1. Subsections (3) through (8) of section 744.604, 
10  Florida Statutes, are reordered and amended to read: 
11         744.604 Definitions.—As used in this part, the term: 
12         (8)(3) “Secretary” means the Secretary of Veterans Affairs 
13  as head of the United States Department of Veterans Affairs or 
14  her or his successor. 
15         (3)(4) “Benefits” means arrears of pay, bonus, pension, 
16  compensation, insurance, and all other moneys paid or payable by 
17  the United States through the United States Department of 
18  Veterans Affairs by reason of service in the Armed Forces of the 
19  United States, and any other moneys due from the United States 
20  Government and payable through its agencies. 
21         (4)(5) “Estate” means income on hand and assets acquired in 
22  whole or in part with income. 
23         (5)(6) “Guardian” means any person acting as a fiduciary 
24  for a ward’s person or the ward’s estate, or both. 
25         (6)(7) “Income” means moneys received from the United 
26  States Department of Veterans Affairs as benefits, and revenue 
27  or profit from any property acquired in whole or in part with 
28  such moneys. 
29         (7)(8) “Person” means an individual, a partnership, a 
30  corporation, or an association. 
31         Section 2. This act shall take effect July 1, 2010.
