Florida Senate - 2021 SB 1564 By Senator Gainer 2-01747-21 20211564__ 1 A bill to be entitled 2 An act relating to the required publication of local 3 board meeting minutes; amending chapter 9820 (1923), 4 Laws of Florida; removing a provision requiring the 5 City of Leesburg City Commission to publish minutes in 6 a newspaper published in the city; amending chapter 7 23342 (1945), Laws of Florida; removing a provision 8 requiring the Holmes County Board of County 9 Commissioners and the Board of Public Instruction to 10 publish minutes in a newspaper of general circulation; 11 repealing chapters 22229 (1943), 22375 (1943), 26296 12 (1949), 26299 (1949), 27578 (1951), 27967 (1951), 13 29600 (1953), 30785 (1955), 31354 (1955), 57-2060, 65 14 1381, 65-1563, 69-1157, 69-1366, 70-780, 71-608, and 15 78-530, Laws of Florida, relating to the publication 16 of minutes of a county school board or a board of 17 county commissioners in a newspaper of general 18 circulation in Calhoun, Liberty, Wakulla, Washington, 19 Gulf, Clay, Franklin, Holmes, Okeechobee, Leesburg, 20 and Dixie Counties; providing an effective date. 21 22 Be It Enacted by the Legislature of the State of Florida: 23 24 Section 1. Section 19 of chapter 9820 (1923), Laws of 25 Florida, is amended to read: 26Section 19.It shall be the duty of the City Clerk and27Auditor to keep correct minutes of the proceedings of the City28Commission and enter the same in a suitable book to be kept for29the purpose. He shall also see that the minutes are promptly30printed in some newspaper published in the City. The Mayor31Commissioner and the City Clerk and Auditor shall sign each and32every minute of the Council, when duly recorded in the minute33book. It shall also be the duty of said City Clerk and Auditor34to record all ordinances and resolutions passed by the said City35Commission after the approval of the same by the Mayor in the36proper ordinance book, and see that same are duly promulgated by37publishing same in some newspaper in said city after the38adoption of the same.39 Section 2. Section 2 of chapter 23342 (1945), Laws of 40 Florida, is amended to read: 41Section 2.The publications provided by the Act shall be42published in a newspaper of general circulation in Holmes43County, Florida, provided, however, that the cost of publishing44same shall not exceed the amount of Twenty-five Dollars per45month for each and in the event that such publication for any46month should cost more than the amount of Twenty-five Dollars to47publish, then the Board required herein to publish its minutes48shall publish the same for such month by posting a true and49correct certified copy thereof, at the front door of the Court50House of said Holmes County, Florida, and the Clerk of the51Circuit Court and no other county official shall receive any52additional fees for the posting thereof.53 Section 3. Chapters 22229 (1943), 22375 (1943), 26296 54 (1949), 26299 (1949), 27578 (1951), 27967 (1951), 29600 (1953), 55 30785 (1955), 31354 (1955), 57-2060, 65-1381, 65-1563, 69-1157, 56 69-1366, 70-780, 71-608, and 78-530, Laws of Florida, are 57 repealed. 58 Section 4. This act shall take effect upon becoming a law.
