Florida Senate - 2024 SB 1586 By Senator Collins 14-00081A-24 20241586__ 1 A bill to be entitled 2 An act relating to enhanced firearms training 3 facilities; creating s. 790.501, F.S.; exempting from 4 local government specified restrictions for the 5 location of licensed enhanced firearms training 6 facilities; providing definitions; establishing 7 procedures for licensure; requiring certain sheriffs 8 to provide an affidavit; specifying the duration of a 9 license; specifying conditions under which a license 10 is revoked; authorizing an enhanced firearms training 11 facility to provide training and certification to the 12 guardian program; requiring the Department of 13 Agriculture and Consumer Services to adopt rules; 14 providing an effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Section 790.501, Florida Statutes, is created to 19 read: 20 790.501 Enhanced firearms training facilities; licensing.- 21 (1) Notwithstanding any law to the contrary, a facility 22 that is licensed under subsection (2) as an enhanced firearms 23 training facility is exempt from any local government planning 24 and zoning or public works restrictions. 25 (2) For purposes of this section, the term: 26 (a) “Enhanced firearms training facility” means a facility 27 located on land zoned for agricultural use or the equivalent 28 which is used to train people in the use of firearms and 29 personal safety. 30 (b) “Owner” means a person who: 31 1. Holds the legal title to the land and facilities upon 32 which the enhanced firearms training facility will be licensed; 33 or 34 2. Holds a percentage interest in the agricultural land and 35 facilities that is equal to or greater than the other persons 36 who also hold a legal interest, if the legal title is held in 37 the name of two or more people. 38 (3) To receive a license, the owner of an enhanced firearms 39 training facility must: 40 (a) Complete and submit an application to the Department of 41 Agriculture and Consumer Services. 42 (b) Have successfully passed a Level 2 background screening 43 as provided in s. 435.04(2). 44 (c) Have no felony conviction. 45 (d) Have successfully completed a chief range safety 46 officer training program approved by the Department of 47 Agriculture and Consumer Services. 48 (e) Hold a class “K” firearms instructor license from the 49 Department of Agriculture and Consumer Services. 50 (4) In addition to meeting the requirements of subsection 51 (3), the owner of an enhanced firearms training facility must 52 provide the Department of Agriculture and Consumer Services with 53 an affidavit from the sheriff who has jurisdiction of the 54 facility, attesting to the fact that the sheriff: 55 1. Has personally visited the land and facilities upon 56 which the enhanced firearms training facility will be licensed. 57 2. Has determined the land and facilities would fulfill a 58 public safety training need for which this section was created. 59 3. Has determined that the land and facilities are large 60 enough and sufficiently equipped to provide enhanced firearms 61 training. 62 (5) An enhanced firearms training facility license must be 63 renewed annually and remains effective for 12 months or until 64 the department determines that the owner of the enhanced 65 firearms training facility is no longer in compliance with 66 paragraph (3)(c), paragraph (3)(d), or paragraph (3)(e). 67 (6) An enhanced firearms training facility may provide 68 training and certification for the guardian program under s. 69 30.15(1)(k). 70 (7) The Department of Agriculture and Consumer Services 71 shall adopt rules to implement this section. 72 Section 2. This act shall take effect July 1, 2024.
