Florida Senate - 2022 SB 1632 By Senator Farmer 34-01110-22 20221632__ 1 A bill to be entitled 2 An act relating to searches by law enforcement 3 officers; creating s. 933.41, F.S.; prohibiting a law 4 enforcement officer in this state from searching a 5 person or his or her property without first informing 6 the person of his or her lawful right to decline the 7 search request by the law enforcement officer; 8 providing exceptions; providing an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Section 933.41, Florida Statutes, is created to 13 read: 14 933.41 Prohibited searches of persons or property without 15 disclosure.—A law enforcement officer in this state may not 16 search a person or his or her property without first informing 17 the person of his or her lawful right to decline the search 18 request by the law enforcement officer, unless the law 19 enforcement officer is carrying out a valid search warrant or 20 the search is based upon another legally sufficient 21 justification. 22 Section 2. This act shall take effect July 1, 2022.
