    1                        A bill to be entitled                      
    2         An act relating to parole; creating s. 947.28, F.S.;
    3         reinstating parole for offenders who solely committed
    4         certain nonviolent felony offenses; providing
    5         exceptions; providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Section 947.28, Florida Statutes, is created to
   10  read:
   11         947.28 Parole reinstatement for certain nonviolent felony
   12  offenders.—
   13         (1)Notwithstanding any law to the contrary, parole is
   14  reinstated in this state for an offender who solely committed
   15  one or more nonviolent felony of the second degree offenses or
   16  nonviolent felony of the third degree offenses, including, but
   17  not limited to:
   18         (a)Drug possession.
   19         (b)Theft, grand theft, or larceny.
   20         (c)Possession of or trafficking of cannabis as defined in
   21  s. 893.02.
   22         (d)Burglary of an unoccupied dwelling, structure, or
   23  conveyance, and he or she was unarmed.
   24         (2)Subsection (1) does not apply to:
   25         (a)A person who has been convicted of committing, or
   26  attempting, soliciting, or conspiring to commit, any of the
   27  following offenses:
   28         1.Section 794.011.
   29         2.Chapter 800.
   30         3.Section 827.03.
   31         4.Section 827.071.
   32         (b)A person who was released pursuant to s. 947.1405 or s.
   33  947.146.
   34         Section 2. This act shall take effect July 1, 2024.
