Florida Senate - 2022 SB 1676 By Senator Pizzo 38-01197-22 20221676__ 1 A bill to be entitled 2 An act relating to Move Over Act penalties; amending 3 s. 318.18, F.S.; revising civil penalties for a motor 4 vehicle driver’s failure, under certain circumstances, 5 to vacate the lane closest to an emergency vehicle or 6 certain other vehicles or comply with specified 7 reduced speed limits; reenacting s. 316.126(1)(b), 8 F.S., relating to the operation of vehicles on 9 approach of an authorized emergency, sanitation, or 10 utility service vehicle, to incorporate the amendment 11 made to s. 318.18, F.S., in references thereto; 12 providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Paragraph (d) of subsection (2) of section 17 318.18, Florida Statutes, is amended, paragraph (i) is added to 18 subsection (3) of that section, and paragraph (b) of subsection 19 (3) of that section is republished, to read: 20 318.18 Amount of penalties.—The penalties required for a 21 noncriminal disposition pursuant to s. 318.14 or a criminal 22 offense listed in s. 318.17 are as follows: 23 (2) Thirty dollars for all nonmoving traffic violations 24 and: 25(d) For all violations of s. 316.126(1)(b), unless26otherwise specified.27 (3) 28 (b) For moving violations involving unlawful speed, the 29 fines are as follows: 30 31 For speed exceeding the limit by: Fine: 32 1-5 mph..................................................Warning 33 6-9 mph......................................................$25 34 10-14 mph...................................................$100 35 15-19 mph...................................................$150 36 20-29 mph...................................................$175 37 30 mph and above............................................$250 38 39 (i) A person cited for a violation of s. 316.126(1)(b)1. 40 shall pay a fine of $500. A person cited for a violation of s. 41 316.126(1)(b)2. shall pay a fine double the amount listed in 42 paragraph (b), except a person cited for exceeding the speed 43 limit by up to 5 mph shall pay a fine of $30. 44 Section 2. For the purpose of incorporating the amendment 45 made by this act to section 318.18, Florida Statutes, in 46 references thereto, paragraph (b) of subsection (1) of section 47 316.126, Florida Statutes, is reenacted to read: 48 316.126 Operation of vehicles and actions of pedestrians on 49 approach of an authorized emergency, sanitation, or utility 50 service vehicle.— 51 (1) 52 (b) If an authorized emergency vehicle displaying any 53 visual signals is parked on the roadside, a sanitation vehicle 54 is performing a task related to the provision of sanitation 55 services on the roadside, a utility service vehicle is 56 performing a task related to the provision of utility services 57 on the roadside, a wrecker displaying amber rotating or flashing 58 lights is performing a recovery or loading on the roadside, or a 59 road and bridge maintenance or construction vehicle displaying 60 warning lights is on the roadside without advance signs and 61 channelizing devices, the driver of every other vehicle, as soon 62 as it is safe: 63 1. Shall vacate the lane closest to the emergency vehicle, 64 sanitation vehicle, utility service vehicle, wrecker, or road 65 and bridge maintenance or construction vehicle when driving on 66 an interstate highway or other highway with two or more lanes 67 traveling in the direction of the emergency vehicle, sanitation 68 vehicle, utility service vehicle, wrecker, or road and bridge 69 maintenance or construction vehicle except when otherwise 70 directed by a law enforcement officer. If such movement cannot 71 be safely accomplished, the driver shall reduce speed as 72 provided in subparagraph 2. 73 2. Shall slow to a speed that is 20 miles per hour less 74 than the posted speed limit when the posted speed limit is 25 75 miles per hour or greater; or travel at 5 miles per hour when 76 the posted speed limit is 20 miles per hour or less, when 77 driving on a two-lane road, except when otherwise directed by a 78 law enforcement officer. 79 Section 3. This act shall take effect July 1, 2022.
