Florida Senate - 2018 SB 1720 By Senator Montford 3-01333A-18 20181720__ 1 A bill to be entitled 2 An act relating to imposing bail fees for certain 3 offenses for use by law enforcement in small counties; 4 creating s. 938.075, F.S.; requiring the clerk of the 5 court to collect a fee on the posting of bail for the 6 violation of certain drug- and alcohol-related 7 offenses; requiring the clerk of the court to remit 8 the fees to the Department of Revenue; requiring the 9 Department of Revenue to deposit the fees into a 10 certain trust fund; requiring the Department of Law 11 Enforcement to use moneys collected from the fees to 12 provide grants to law enforcement agencies in counties 13 of a certain size to conduct drug enforcement and 14 related activities in those counties; providing an 15 effective date. 16 17 Be It Enacted by the Legislature of the State of Florida: 18 19 Section 1. Section 938.075, Florida Statutes, is created to 20 read: 21 938.075 Bail surcharge in drug and alcohol cases; use by 22 small counties.— 23 (1) A fee of $10 is imposed on the granting of bail to a 24 defendant charged with a violation of s. 316.193, s. 327.35, s. 25 856.011, s. 856.015, or chapter 893. The clerk of the court 26 shall collect the fee at the time that bail is posted under 27 chapter 903 and remit it to the Department of Revenue. The 28 Department of Revenue shall deposit the proceeds of the fee into 29 the Department of Law Enforcement Operating Trust Fund for the 30 purposes specified in this section. 31 (2) The Department of Law Enforcement shall use the fees 32 collected under this section to provide grants to law 33 enforcement agencies in counties with a population of 50,000 or 34 fewer unincarcerated persons to conduct drug enforcement and 35 related activities in those counties. Such activities may 36 include, but are not limited to, paying the salaries of 37 investigators, purchasing equipment and supplies, training law 38 enforcement personnel and fire rescue personnel who are 39 responsible for rendering aid to persons victimized by illegal 40 drug trafficking and manufacturing, and the cleanup of sites 41 where illegal drugs have been manufactured. 42 Section 2. This act shall take effect October 1, 2018.
