    1                        A bill to be entitled                      
    2         An act relating to affordable housing; amending ss.
    3         125.01055 and 166.04151, F.S.; requiring, rather than
    4         authorizing, inclusionary housing ordinances to
    5         require developers to provide a specified number or
    6         percentage of affordable housing units; deleting the
    7         authorization for a developer to contribute to a
    8         housing fund or other alternatives in lieu of building
    9         affordable housing units; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (2) of section 125.01055, Florida
   14  Statutes, is amended to read:
   15         125.01055 Affordable housing.—
   16         (2) An inclusionary housing ordinance must may require a
   17  developer to provide a specified number or percentage of
   18  affordable housing units to be included in a development or
   19  allow a developer to contribute to a housing fund or other
   20  alternatives in lieu of building the affordable housing units.
   21         Section 2. Subsection (2) of section 166.04151, Florida
   22  Statutes, is amended to read:
   23         166.04151 Affordable housing.—
   24         (2) An inclusionary housing ordinance must may require a
   25  developer to provide a specified number or percentage of
   26  affordable housing units to be included in a development or
   27  allow a developer to contribute to a housing fund or other
   28  alternatives in lieu of building the affordable housing units.
   29         Section 3. This act shall take effect July 1, 2024.
