    1                        A bill to be entitled                      
    2         An act relating to pharmacy and dietary services at
    3         assisted living facilities; amending s. 429.42, F.S.;
    4         deleting obsolete provisions relating to a corrective
    5         action plan and a requirement that two pharmacists
    6         assist with inspections at assisted living facilities
    7         under certain conditions; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (4) of section 429.42, Florida
   12  Statutes, is renumbered as subsection (2), and present
   13  subsections (2) and (3) of that section are amended to read:
   14         429.42 Pharmacy and dietary services.—
   15         (2) A corrective action plan for deficiencies related to
   16  assistance with the self-administration of medication or the
   17  administration of medication must be developed and implemented
   18  by the facility within 48 hours after notification of such
   19  deficiency, or sooner if the deficiency is determined by the
   20  agency to be life-threatening.
   21         (3) The agency shall employ at least two pharmacists
   22  licensed pursuant to chapter 465 among its personnel who
   23  biennially inspect assisted living facilities licensed under
   24  this part, to participate in biennial inspections or consult
   25  with the agency regarding deficiencies relating to medicinal
   26  drugs or over-the-counter preparations.
   27         Section 2. This act shall take effect July 1, 2011.
