Florida Senate - 2019 CS for SB 1800 By the Committee on Community Affairs; and Senator Gibson 578-03295-19 20191800c1 1 A bill to be entitled 2 An act relating to the Florida Building Code; amending 3 s. 553.73, F.S.; authorizing the Florida Building 4 Commission to adopt certain triennial amendments; 5 providing an effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1. Paragraphs (a) and (c) of subsection (7) of 10 section 553.73, Florida Statutes, are amended to read: 11 553.73 Florida Building Code.— 12 (7)(a) The commission shall adopt an updated Florida 13 Building Code every 3 years through review of the most current 14 updates of the International Building Code, the International 15 Fuel Gas Code, International Existing Building Code, the 16 International Mechanical Code, the International Plumbing Code, 17 and the International Residential Code, all of which are 18 copyrighted and published by the International Code Council, and 19 the National Electrical Code, which is copyrighted and published 20 by the National Fire Protection Association. At a minimum, the 21 commission shall adopt any updates to such codes or any other 22 code necessary to maintain eligibility for federal funding and 23 discounts from the National Flood Insurance Program, the Federal 24 Emergency Management Agency, and the United States Department of 25 Housing and Urban Development. The commission shall also review 26 and adopt updates based on the International Energy Conservation 27 Code (IECC); however, the commission shall maintain the 28 efficiencies of the Florida Energy Efficiency Code for Building 29 Construction adopted and amended pursuant to s. 553.901. The 30 commission may approve triennial amendments to the Florida 31 Building Code without a finding that the amendments are needed 32 in order to accommodate the specific needs of this state. The 33 commission shall adopt updated codes by rule. 34 (c) The commission may also adopt as a technical amendment 35 to the Florida Building Code any portion of the codes identified 36 in paragraph (a), but only as needed to accommodate the specific 37 needs of this state. Standards or criteria adopted from these 38 codes shall be incorporated by reference to the specific 39 provisions adopted. If a referenced standard or criterion 40 requires amplification or modification to be appropriate for use 41 in this state, only the amplification or modification shall be 42 set forth in the Florida Building Code. The commission may 43 approve technical amendments to the updated Florida Building 44 Code after the amendments have been subject to the conditions 45 set forth in paragraphs (3)(a)-(d). Amendments that are adopted 46 in accordance with this subsection shall be clearly marked in 47 printed versions of the Florida Building Code so that the fact 48 that the provisions are amendments is readily apparent. 49 Section 2. This act shall take effect January 1, 2020.
