    1                        A bill to be entitled                       
    2         An act relating to Hillsborough County; authorizing 
    3         the Division of Alcoholic Beverages and Tobacco of the 
    4         Department of Business and Professional Regulation to 
    5         issue an alcoholic beverage license to the Children’s 
    6         Museum of Tampa, Inc., to use within the museum’s 
    7         building and on its grounds; providing that the 
    8         license may be used only for special events; providing 
    9         for payment of the license fee; providing for sale of 
   10         beverages for consumption within the museum’s building 
   11         and on its grounds; prohibiting sales for consumption 
   12         off premises; providing for removal from the premises 
   13         of partially consumed, open containers; authorizing 
   14         transfer and providing for subsequent reversion of the 
   15         license under certain circumstances; providing an 
   16         effective date.

   18  Be It Enacted by the Legislature of the State of Florida: 
   19   
   20         Section 1. Notwithstanding any other provision of law, the 
   21  Division of Alcoholic Beverages and Tobacco of the Department of 
   22  Business and Professional Regulation is authorized, upon 
   23  application, to issue an alcoholic beverage license in 
   24  accordance with section 561.17, Florida Statutes, to the 
   25  Children’s Museum of Tampa, Inc., (the “museum”), 110 W. 
   26  Gasparilla Plaza, Tampa, a not-for-profit corporation, for use 
   27  within the building known as the Children’s Museum of Tampa, 
   28  Inc., and on its adjoining grounds. The museum shall pay the 
   29  applicable license fee provided in section 565.02, Florida 
   30  Statutes. The license may be used only for special events. 
   31         Section 2. Alcoholic beverages may be sold by the licensee 
   32  for consumption within the building and on the grounds of the 
   33  museum. The license issued pursuant to this act does not permit 
   34  the sale of alcoholic beverages in sealed containers for 
   35  consumption outside the building and its grounds. This act does 
   36  not prevent a purchaser of such alcoholic beverages from 
   37  removing an opened, partially consumed container of alcoholic 
   38  beverages from the premises of the museum. 
   39         Section 3. The museum may transfer the license from time to 
   40  time to qualified applicants who are either authorized by or 
   41  under contract with the museum to provide food services at the 
   42  museum. Upon termination of a transferee’s authorization or 
   43  contract, the license automatically reverts by operation of law 
   44  to the museum. 
   45         Section 4. This act shall take effect upon becoming a law.
