A BILL TO BE ENTITLED
AN ACT


To amend Code Section 22-1-2 of the Official Code of Georgia Annotated, relating to nature of right of eminent domain and property to be put to public use, so as to provide that the ownership of property seized to mitigate blight may be transferred within 20 years of the initial condemnation; to provide that the zoning of such property cannot be changed to a more intense use for a period of one year following condemnation; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 22-1-2 of the Official Code of Georgia Annotated, relating to nature of right of eminent domain and property to be put to public use, is amended by revising subsection (b) as follows:
"(b) All condemnations shall not be converted to any use other than a public use for 20 years from the initial condemnation; provided, however, that, in the case of property condemned to remedy blight, the condemnor may transfer ownership of the property at any time following the initial condemnation; and, provided, further, that in no event shall the zoning of such property be changed to a more intense density or use than that existing at the time of condemnation for a period of one year following the effective date of the condemnation."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
