BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 20-2-600 of the Official Code of Georgia Annotated, relating
to the leasing of public school property for private purposes authorized, so as
to prohibit the leasing of certain public school property for the purpose of
erecting telecommunications towers; to provide an effective date; to provide for
applicability; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 20-2-600 of the Official Code of Georgia Annotated, relating to the
leasing of public school property for private purposes authorized, is amended as
follows:
"20-2-600.
The
various counties, cities, municipalities, county boards of education, city
boards of education, and governing bodies of independent school districts or
systems of this state shall have authority to lease any schoolhouse or other
school property that it has determined is no longer needed for school purposes
to any person, group of persons, or corporation, provided that the lease shall
be for a period not longer than 50
years; and
provided, further, that no lease of any public elementary, middle, or high
school property for the construction and maintenance of any telecommunications
tower shall be allowed."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval; and this Act shall be applied
retroactively.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
