BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act revising, superseding, and consolidating the laws creating and
governing the Board of Commissioners of Echols County, approved February 3, 1953
(Ga. L. 1953, Jan.-Feb. Sess., p. 2054), as amended, so as to provide for
elections and terms of office; to provide for submission under the federal
Voting Rights Act of 1965, as amended; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act revising, superseding, and consolidating the laws creating and governing the
Board of Commissioners of Echols County, approved February 3, 1953 (Ga. L. 1953,
Jan.-Feb. Sess., p. 2054), as amended, is amended by revising Section 2 as
follows:
"SECTION
2.
(a)
There shall be a Board of Commissioners of Echols County, to consist of three
persons to be elected by the voters of Echols County and commissioned by the
Governor. There shall be three posts on said board, designated as Post 1, Post
2, and Post 3. Each candidate for office on the board of commissioners shall be
required to designate by number the post to which he or she seeks to be elected.
Elections of members of the board shall be held in accordance with Chapter 2 of
Title 21 of the O.C.G.A., the 'Georgia Election Code.'
(b)(1)
Beginning in 2012 and thereafter, the members of the board elected from Posts 1
and 2 at the general election in November shall serve for terms of four years
each commencing on January 1 immediately following such election and until their
successors are elected and qualified.
(2)(A)
The member of the board elected from Post 3 at the general election in November,
2012, shall serve for an initial term of two years commencing on January 1
immediately following such election and until his or her successor is elected
and qualified.
(B)
Beginning in 2014 and thereafter, the member of the board elected from Post 3 at
the general election in November shall serve for a term of four years,
commencing on January 1 immediately following such election and until his or her
successor is elected and qualified."
SECTION
2.
The
Board of Commissioners of Echols County shall through its legal counsel cause
this Act to be submitted for preclearance under Section 5 of the federal Voting
Rights Act of 1965, as amended, no later than 45 days after the date on which
this Act is approved by the Governor or otherwise becomes law without such
approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
