BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 8 of Title 35 of the Official Code of Georgia Annotated, relating
to employment and training of peace officers, so as to require governmental
entities to verify that employees exercising the powers of arrest are certified;
to provide for related matters; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
8 of Title 35 of the Official Code of Georgia Annotated, relating to employment
and training of peace officers, is amended by adding a new Code section to read
as follows:
"35-8-27.
No
agency, department, authority, commission, or other governmental entity of this
state or any subdivision of this state shall authorize an employee, contractor,
or subcontractor to exercise the power of arrest, including the issuance of a
traffic citation, without ensuring that such employee, contractor, or
subcontractor is certified in accordance with this chapter. Governmental
entities shall routinely verify that all certified employees, contractors, and
subcontractors authorized to exercise the power of arrest maintain a current and
valid certification."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
