A BILL TO BE ENTITLED
AN ACT


To amend Code Section 20-3-519.1 of the Official Code of Georgia Annotated, relating to ineligibility for HOPE scholarships and grants, so as to provide for a family income limit on eligibility; to provide that the Georgia Student Finance Commission may adjust the income limit under certain conditions; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 20-3-519.1 of the Official Code of Georgia Annotated, relating to ineligibility for HOPE scholarships and grants, is amended by designating the existing text of the Code section as subsection (a) and by adding thereafter a new subsection (b) to read as follows:
"(b)(1) A student is ineligible for any scholarship or grant described in this part if the total of the preceding calendar year's federal adjusted gross income of the student, the student's parents, and the student's spouse, if any, exceeds the applicable income limit.
(2) For scholarships and grants awarded in calendar year 2012, the income limit shall be $66,000.00.
(3) For future years, the Georgia Student Finance Commission may adjust the income limit so as to make scholarships and grants available to as many otherwise eligible students as possible while ensuring that all shortfall reserve subaccounts within the Lottery for Education Account remain fully funded."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
