BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend an Act providing a new charter for the City of Douglas, approved March 10,
1993 (Ga. L. 1993, p. 4022), as amended, so as to revise the
provisions for the filling of vacancies in the office of mayor or commission
member; to provide for related matters; to repeal conflicting laws; and for
other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act providing a new charter for the City of Douglas, approved March 10, 1993
(Ga. L. 1993, p. 4022), as amended, is amended by revising
subsection (a) of Section 2.15 as follows:
"(a)
In the event that the office of mayor or commission member shall become vacant
upon the incumbent's death, resignation, forfeiture of office, or removal from
office in any manner authorized by this charter or the general laws of the State
of Georgia and there is one year or less remaining in such person's term of
office, the city commission or those remaining shall appoint a qualified
individual to fill the balance of the unexpired term of such person. In the
event that there is more than one year remaining in such person's term of
office, the vacancy shall be filled by special election called and held in
accordance with Code Section 21-2-540 of the O.C.G.A. In the event that all
seats on the commission are vacant, such vacancies shall be filled in accordance
with the provisions of Code Section 36-30-13."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
