BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 60 of Title 36 of the Official Code of Georgia Annotated, relating
to general provisions applicable to counties and municipalities, so as to
provide for nonexclusive franchise agreements with respect to certain open top
roll off dumpsters; to provide that certain exclusive franchise agreements are
against public policy; to provide for related matters; to provide for notice of
displacement of residential solid waste collection firms by counties and cities;
to provide an effective date; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
60 of Title 36 of the Official Code of Georgia Annotated, relating to general
provisions applicable to counties and municipalities, is amended by adding new
Code sections to read as follows:
"36-60-27.
The
governing authority of any county or municipality in this state is authorized to
enter into nonexclusive franchise agreements with private persons, firms,
associations, or corporations for open top roll off dumpsters which are 22 feet
or less in length placed at construction sites for the collection and disposal
of construction debris or inert debris. Such governing authority shall not
impose any fee for such nonexclusive franchise agreements. It shall be against
the public policy of this state for the governing authority of any county or
municipality to enter into an exclusive franchise agreement with private
persons, firms, associations, or corporations for such dumpsters to be placed at
such sites.
36-60-28.
No
firms providing residential solid waste collection services in a portion or all
of a county or municipality shall be displaced by such county or municipality
from providing residential solid waste collection services in any area of the
county or municipality unless the county or municipality provides public notice
of its intention to displace such firms at least two years in advance of such
displacement."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
