A BILL TO BE ENTITLED
AN ACT


To establish a method of appointment for members of the board of the Americus and Sumter County Hospital Authority as authorized pursuant to subsection (d) of Code Section 31-7-72 of the O.C.G.A.; to provide for legislative intent; to provide for direct appointment of members to such authority by the governing bodies of Sumter County and the City of Americus; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Having been requested by resolution of the governing body of the City of Americus and the Board of Commissioners of Sumter County to make the Americus and Sumter County Hospital Authority more responsive to the voters and taxpayers of the City of Americus and Sumter County, it is the intent of the General Assembly to accommodate this request by revising the method of appointment of members of the hospital authority pursuant to subsection (d) of Code Section 31-7-72 of the O.C.G.A. by placing the powers of appointment of members of the hospital authority in the governing body of the City of Americus and Board of Commissioners of Sumter County.

SECTION 2.
Pursuant to subsection (d) of Code Section 31-7-72 of the O.C.G.A., appointments to fill vacancies on the board of the Americus and Sumter County Hospital Authority for either an unexpired or full term pursuant to the resolution creating such authority shall be made as follows:
(1) The authority shall continue to consist of nine members, with five members appointed by the Board of Commissioners of Sumter County and four members appointed by the City of Americus, unless changed or modified by proper resolution of such governing bodies as authorized by law;
(2) The Board of Commissioners of Sumter County shall appoint an eligible person to fill each vacancy on the authority for which it has the authority to appoint under this Act. The seats that are to be filled by the appointment by the Board of Commissioners of Sumter County shall be the same seats that such board was authorized to fill by appointment immediately prior to the effective date of this Act. No appointee of the Board of Commissioners of Sumter County shall be subject to approval of the authority prior to taking office as a member of the authority board; and
(3) The governing body of the City of Americus shall appoint an eligible person or persons to fill each vacancy on the authority for which it has the authority to appoint under this Act. The seats that are to be filled by appointment of the governing body of the City of Americus shall be the seats that the governing body of the City of Americus was authorized to fill by appointment prior to the effective date of this Act. No appointee of the governing body of the City of Americus shall be the subject to approval of the authority prior to taking office as a member of the authority board.

SECTION 3.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
