BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 1 of Chapter 7 of Title 3 of the Official Code of Georgia
Annotated, relating to general provisions for the sale of distilled spirits by
private clubs, so as to authorize the sale of alcoholic beverages by nonprofit
organizations without a license during a single function; to provide for related
matters; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
1 of Chapter 7 of Title 3 of the Official Code of Georgia Annotated, relating to
general provisions for the sale of distilled spirits by private clubs, is
amended by adding a new Code section to read as follows:
"3-7-3.
(a)
As used in this Code section, the term:
(1)
'Nonprofit organization' means any nonprofit association organized under the
laws of this state and includes any member, employee, volunteer, or other person
working on behalf of such nonprofit organization.
(2)
'Single function' means an individually scheduled event that lasts not longer
than 24 hours and where the sale of alcohol does not occur more than once a
month at the same location.
(b)
Notwithstanding any other provision to the contrary, a nonprofit organization is
authorized to sell distilled spirits or other alcoholic beverages by the drink
for consumption at a single function without having to obtain from any
governmental agency a license, permit, or other authorization for the sale of
distilled spirits or other alcoholic
beverages."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
