A
RESOLUTION
Urging
the Supreme Court of Georgia to disbar or disallow admission to the bar any
attorney who is convicted of altering or backdating a legal document; and for
other purposes.
WHEREAS,
membership in the State Bar of Georgia by attorneys who practice law in this
state is regulated by the Supreme Court of Georgia; and
WHEREAS,
the Supreme Court has established rules governing membership in the state bar;
and
WHEREAS,
the rules governing misconduct by members of the state bar specifically prohibit
engaging in professional conduct involving fraud or deceit; and
WHEREAS,
it has come to the attention of this body that members of the state bar have
been known to have been convicted of or have admitted to fraudulently altering
or backdating, or both altering and backdating, legal documents;
and
WHEREAS,
altering or backdating legal documents constitutes a violation of the rules
governing the professional conduct of Georgia attorneys.
NOW,
THEREFORE, BE IT RESOLVED BY THE HOUSE OR REPRESENTATIVES that the members of
this body urge the Supreme Court of Georgia immediately to revoke the license to
practice law in this state of any attorney who admits to or is convicted of
altering or backdating legal documents as soon as such action comes to the
attention of the court or the State Bar of Georgia without the necessity of
filing a formal complaint.
BE
IT FURTHER RESOLVED that the Supreme Court of Georgia is urged to disallow the
admission to the State Bar of Georgia of any attorney who has admitted to or
been convicted of altering or backdating legal documents at any time and in any
jurisdiction.
BE
IT FURTHER RESOLVED that the Clerk of the House of Representatives is authorized
and directed to transmit an appropriate copy of this resolution to the Supreme
Court of Georgia and the State Bar of Georgia.
