A RESOLUTION


Proposing an amendment to the Constitution so as to provide for a complete and permanent exemption from ad valorem taxes and fees for any and all purposes for property if the taxpayer pays an amount equal to 20 times the amount of ad valorem taxes and fees due and payable for the current-year assessed value of such property; to provide for definitions; to specify the terms and conditions of the exemption and procedures relating thereto; to provide for a short title; to provide for the submission of this amendment for ratification or rejection; and for other purposes.

BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
This resolution shall be known and may be cited as the "Freedom of Ownership Amendment."

SECTION 2.
Article VII, Section II of the Constitution is amended by adding a new Paragraph to read as follows:
"Paragraph VI. Exemptions for prepaid ad valorem taxes. (a) For purposes of this Paragraph, the term:
(1) 'Ad valorem taxes' means any and all ad valorem taxes for any purposes, including, but not limited to, taxes to pay interest on and to retire bonded indebtedness.
(2) 'Taxpayer' means a person or entity subject to ad valorem taxes for property owned by the person or entity.
(b) Any property shall be granted a complete and permanent exemption from ad valorem taxes and fees if the taxpayer pays an amount equal to 20 times the amount of ad valorem taxes and fees due and payable for the current-year assessed value of that property. The exemption provided under this subparagraph shall apply to the property and any improvements thereto existing on the date such exemption is granted. Any additions or improvements thereto which are added subsequent to the granting of the exemption shall not qualify for or receive such exemption unless the taxpayer pays an amount equal to 20 times the amount of ad valorem taxes and fees due and payable for the current-year assessed value of such additions or improvements. Such exemption shall attach to and run with such property, and such property shall not be subject thereafter to any future ad valorem taxes or fees regardless of any future transfer of such property."

SECTION 3.
The above proposed amendment to the Constitution shall be published and submitted as provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the above proposed amendment shall have written or printed thereon the following:
"(  )  YES
(  )  NO

Shall the Constitution of Georgia be amended so as to provide a complete and permanent exemption from ad valorem taxes and fees for any and all purposes for property if the taxpayer pays an amount equal to 20 times the amount of ad valorem taxes and fees due and payable for the current-year assessed value of such property?"
All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes." All persons desiring to vote against ratifying the proposed amendment shall vote "No." If such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall become a part of the Constitution of this state.
