A BILL FOR AN ACT

 

 

relating to health care.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to convene a care homes task force to transition certain care home programs and services from the department of human services to the department of health pursuant to Act 93, Session Laws of Hawaii 2012.

     SECTION 2.  (a)  There is established a care homes task force, which shall be placed in the department of health for administrative purposes only, and which shall examine an efficient and effective way to transition to the department of health the programs of the department of human services relating to:

     (1)  Home and community-based management;

     (2)  Community care foster family homes; and

     (3)  Adult day care.

     The task force shall strive to effectuate the purpose of Act 93, Session Laws of Hawaii 2012, in carrying out its duties.

     (b)  The task force shall consist of the following members:

     (1)  One member of the senate appointed by the senate                   president;

     (2)  One member of the house of representatives appointed               by the speaker of the house of representatives;

     (3)  Three case managers;

     (4)  Three representatives from community care foster                   family homes;

     (5)  Three representatives from adult residential care              homes;

     (6)  One representative from adult day care centers;

     (7)  One representative from the department of health; and

     (8)  One representative from the department of human                    services.

     No member shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation as a member of the task force.

     (c)  The members of the task force shall serve without compensation.  The department of health shall provide all necessary administrative, professional, technical, and clerical support required by the task force.

     (d)  The task force shall submit to the legislature, no later than twenty days prior to the convening of the regular session of 2014, a final report of its activities, findings, and recommendations.

     (e)  The task force shall cease to exist on June 30, 2014.

     SECTION 3.  This Act shall take effect on July 1, 2013.
