STATE OF HAWAII

A BILL FOR AN ACT

RELATING TO TRANSIENT ACCOMMODATIONS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 237D-4, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

"(c) Any advertisement, including an online advertisement, for any transient accommodation or resort time share vacation interest, plan, or unit shall conspicuously provide:

(1) The registration identification number or an electronic link to the registration identification number of the operator or plan manager issued pursuant to this section; [~~and~~]

(2) The general excise tax license number or an electronic link to the general excise tax license number of the operator or plan manager issued pursuant to chapter 237;

(3) The short-term rental permit number or an electronic link to the short-term rental permit number of the operator or plan manager issued by the county in which the transient accommodation or resort time share vacation interest, plan, or unit is located; and

[~~(2)~~] (4) The local contact's name, phone number, and electronic mail address, provided that this paragraph shall be considered satisfied if this information is provided to the transient or occupant prior to the furnishing of the transient accommodation or resort time share vacation unit."

SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2021.
