Report Title:

Description:

Requires the Hawaii public housing authority to implement policies that reduce vacancies in public housing by 20% each year for the next 4 years.  Requires the authority to annually assess tenant income to determine their continued eligibility for public housing.  Requires the authority to submit annual reports to the legislature on the number of vacant units in public housing projects and related information.

A BILL FOR AN ACT


 

 

relating to public housing.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 356D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§356D-    Vacancy reduction timetable.  The authority shall develop and implement a policy to reduce vacancies in public housing according to the following timetable based upon the number of vacancies on July 1, 2009:

     (1)  Twenty per cent reduction in vacancies by December 31, 2010;

     (2)  Forty per cent reduction in vacancies by December 31, 2011;

     (3)  Sixty per cent reduction in vacancies by December 31, 2012; and

     (4)  Eighty per cent reduction in vacancies by December 31, 2013."

     SECTION 2.  Chapter 356D, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§356D-    Federal low-income housing rentals; income eligibility requirements.  (a)  The authority shall adopt rules providing criteria for reexamining, at least once every twelve months, a tenant's annual income, assets, family composition, and any other relevant criteria to determine a tenant's rent and eligibility for continued occupancy.

     (b)  A tenant found ineligible for continued occupancy shall vacate the dwelling unit within ninety days of the date of ineligibility unless otherwise provided by federal law.

     (c)  The rules may allow the asset and income limits to have a higher ceiling than the asset and income limits for the tenant's initial admission to a project and shall be regularly reviewed and adjusted for inflation."

     SECTION 3.  Section 356D-20, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§356D-20[]]  Duty to make reports.  Except as otherwise provided by law, the authority shall be responsible for the following reports:

     (1)  The authority shall file at least once a year with the governor a report of its activities for the preceding fiscal year;

     (2)  The authority shall report to the comptroller on moneys deposited in depositories other than the state treasury under section 40-81, and rules adopted thereunder; and

     (3)  The authority shall submit an annual report to the legislature on all program areas no later than twenty days prior to the convening of each regular session[,] that shall provide the following information on the status of its programs and finances:

         (A)  A financial audit and report conducted on an annual basis by a certified public accounting firm; [and]

         (B)  The number of vacant units in public housing projects, how long each unit was vacant, reasons for each vacancy, efforts made to place an individual or family in each vacant unit, including the process for repairing the unit if applicable, and measures taken by the authority to work with the community to address vacancies; and

        [(B)] (C)  Recommendations with reference to any additional legislation or other action that may be necessary to carry out the purposes of this chapter."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
