A BILL FOR AN ACT

 

 

RELATING TO THE UNIVERSITY OF HAWAII.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that individual legislators and other elected officials of the State and its counties have a wide range of experience in the public and private sectors that often brings specialized knowledge and insight to policy-making.  Elected officials often have continued to maintain other employment during their terms in elected office or while pursuing candidacy for an office, as duties and time constraints allow, and have provided valuable service in each of those respective capacities.

     The purpose of this Act is to authorize the University of Hawaii to employ a legislator or other official elected to a non-statewide public office of the State or non-countywide public office of its political subdivisions, or candidate for any of those offices, at the University of Hawaii in a non-executive or non-managerial level, as a casual employee, so long as the duties and schedule of the candidate or elected official do not conflict with those of that person's position at the university.

     The legislature declares that this issue is a matter of statewide concern.

     SECTION 2.  Chapter 88, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§88-    University of Hawaii employees serving as elective officers.  If a member who is an employee of the University of Hawaii becomes an elective officer and remains an employee of the University of Hawaii while serving as an elective officer, the member shall not earn any additional benefits under this chapter by reason of the member's service as an elective officer during the period in which the member is both an employee of the University of Hawaii and an elected officer.  If a member who is an elective officer becomes an employee of the University of Hawaii and remains an elective officer while employed by the University of Hawaii, the member shall not earn any additional benefits under this chapter by reason of the member's employment by the University of Hawaii during the period in which the member is both an employee of the University of Hawaii and an elective officer."

     SECTION 3.  Chapter 304A, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:

     "§304A-    Employment of political candidates and officials elected to non-statewide or non-countywide public office.  (a)  The university may employ a candidate for, or person elected to, a non-statewide public office of the State or non-countywide public office of any of its political subdivisions as a casual employee in a non-executive or non-managerial position at the university; provided that this section shall not apply if the person's work schedule and time demands related to the candidacy or duties of elective office unreasonably conflict with those of the university position.

     (b)  As used in this section:

     "Candidate" means a person who has filed applicable nomination papers with the chief election officer or county clerk for an elective public office of the State or any of its political subdivisions.

     "Casual employee" has the same meaning as "part-time, temporary, and seasonal or casual employee" as defined in section 87A-1."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2091.
