A BILL FOR AN ACT
RELATING TO PLANNED COMMUNITY ASSOCIATIONS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§421J- Installation of security cameras. No
association may:
(1) Assess a fine to any member or tenant
of a unit; or
(2) Require a member or tenant of a unit
to undergo an architectural review by the association's architectural review committee,
for any security camera that is commercially
available to the general public for home security use on the exterior of a member's
or tenant's unit if installed three or more years prior to the effective date of
this Act or if installed by or on behalf of a previous member or tenant who occupied
the unit; provided that the association may assess a fine on the member or tenant
of a unit if the security camera is installed in a haphazard fashion such that external
wiring is visible."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.

Description:
Prohibits any planned community association from assessing a fine or requiring an architectural review for any security camera commercially available to the general public on the exterior of a member's or tenant's unit if installed for a certain duration or if installed by or on behalf of a previous member or tenant who occupied the unit. Authorizes a fine if the security camera is installed in a haphazard fashion.
