A BILL FOR AN ACT

 

 

relating to driver education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 286-108.4, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§286-108.4  Driver education and behind-the-wheel driver training program.[](a)  The director of transportation is directed to establish and certify a statewide driver education program and behind-the-wheel driver training program, to include the number of course hours, curriculum, and certification of teachers and third-party examiners.

     (b)  The statewide driver education program and behind-the-wheel driver training program shall include, as part of the programs' curriculum, instruction relating to organ and tissue donation in accordance with section 286-109.5.  Instruction relating to organ and tissue donation shall also include organ donation awareness, with an emphasis on the life-saving and life-restoring effects of organ and tissue donation, and include information about online organ and tissue donation registration in Hawaii.  Instructional materials related to organ and tissue donation shall be developed in coordination with a federally designated organ procurement organization in the State.  For students of either program who are minors, each program shall:

     (1)  Notify parents or guardians of the instruction relating to organ and tissue donation;

     (2)  Make instructional materials available for inspection by parents or guardians; and

     (3)  Obtain consent to provide the instruction from parents or guardians.

A student of either program who is a minor may be excused from receiving instruction relating to organ and tissue donation if a request is made in writing by a parent or guardian.

     (c)  The director of transportation is [also] directed to set a cost for the programs to enable the programs to be self-sufficient.

     (d)  The director of transportation shall adopt rules pursuant to chapter 91 necessary for the purposes of this [[]section[]]."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
