A BILL FOR AN ACT

 

 

relating to traffic accident investigation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  The legislature finds that traffic accident investigations often are complex and time-consuming, and cause significant lane closures and traffic delays.  The legislature also finds that the Washington state patrol has established a major accident investigation team charged with investigating certain types of collisions that occur within its jurisdiction.  Hawaii would benefit by establishing similar major accident investigation teams to expedite the investigation of major accidents and minimize related traffic delays.

The purpose of this Act is to require each county with a population greater than five hundred thousand to establish a major accident investigation team composed of personnel qualified to expedite investigations of accidents defined by specific criteria.

     SECTION 2.  Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§286-     Major accident investigation team; establishment; duties.  (a)  The chief of police of each county with a population greater than five hundred thousand shall coordinate with the director to form a major accident investigation team.

(b)  Each major accident investigation team shall include personnel from the county police department and the department of transportation as may be necessary to expeditiously process and complete a major accident investigation in order to minimize any traffic disruption that may be caused by the major accident investigation.

(c)  The chief of police and the director shall establish criteria for determining the scope of the major accident investigation team's responsibilities and procedures to thoroughly and expeditiously investigate major accidents and minimize related traffic delays."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2014-2015 for the purpose of defraying costs associated with the establishing of major accident investigation teams in counties affected by this Act.  The legislature declares that the appropriation authorized in this section fulfills the requirements of article VIII, section 5 of the Hawaii State Constitution.

     The sum appropriated shall be allotted by the director of finance to counties affected by this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2014.
