A BILL FOR AN ACT
RELATING TO the workplace.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§711- Bullying in the workplace. (1) A person commits the offense of bullying in the workplace if the person intentionally subjects an employee or co-worker to abusive conduct in the workplace that causes physical or psychological harm to the employee or co-worker.
(2) Bullying in the workplace is a misdemeanor.
(3) A person convicted under this section shall be required to undergo a counseling program as ordered by the court."
SECTION 2. Section 711-1100, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:
""Abusive conduct" means malicious conduct, whether by act or omission, that a reasonable person would find hostile, offensive, and unrelated to an employer's legitimate business interests."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
