A BILL FOR AN ACT

 

 

relating to Education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that out of the 400,000 people nationwide who suffer an out-of-hospital cardiac arrest every year, only six per cent survive the crisis.  A critical factor in a person's survival is whether the cardiac arrest is witnessed by someone trained in cardiopulmonary resuscitation.  The American Heart Association's cardiopulmonary resuscitation guidelines reported that in studies of out-of-hospital cardiac arrest, adults who received cardiopulmonary resuscitation from a bystander were more likely to survive than those who did not receive any type of cardiopulmonary resuscitation.  Cities that have increased training for cardiopulmonary resuscitation have seen cardiac arrest survival rates reach as high as sixty per cent.

     The legislature further finds that the department of education has purchased cardiopulmonary resuscitation mannequins and training materials for use by high school health class instructors.  In addition, cardiopulmonary resuscitation training can be accomplished in a thirty-minute session.

     The purpose of this Act is to require that all public high school students receive instruction in administering cardiopulmonary resuscitation with hands-on practicing.

     SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-     Cardiopulmonary resuscitation education.  (a)  Beginning with the 2019-2020 school year, the department shall begin implementation of a cardiopulmonary resuscitation education program established pursuant to subsection (c).

     (b)  No later than the 2023-2024 school year, the cardiopulmonary resuscitation education program established pursuant to subsection (c) shall be implemented statewide.

     (c)  The cardiopulmonary resuscitation education program shall be established within the health education standards or physical education standards for students in grades nine through twelve, to provide instruction in cardiopulmonary resuscitation.  Instruction provided pursuant to this section shall:

     (1)  Include hands-on practicing of cardiopulmonary resuscitation, unless a student is unable to participate in hands-on practicing by reason of disability; and

     (2)  Be consistent and uniform with current nationally recognized emergency cardiac care standards, procedures, and guidelines promoted by the American Heart Association, American Red Cross, or another organization approved by the board."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2018-2019 to support development and implementation of the health education standards and physical education standards to include instruction in cardiopulmonary resuscitation.

     The sum appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2018.
