A BILL FOR AN ACT

 

 

relating to solid waste management.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 342G, Hawaii Revised Statutes, is amended by adding a new section in Part III to be appropriately designated and to read as follows:

     "§342G-     Municipal solid waste prohibition.  (a)  Beginning July 1, 2012, no landfill in a county with a population greater than five hundred thousand residents shall accept deliveries of municipal solid waste.

     (b)  After a date to be determined by resolution of the respective county council, no landfill in a county with a population of less than five hundred thousand residents shall accept deliveries of municipal solid waste.

     (c)  The prohibitions of this section shall not apply to special waste or waste created as a result of a natural disaster."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Prohibits landfills in counties with populations greater than five hundred thousand residents from accepting deliveries of municipal solid waste, beginning July 1, 2012.  Prohibits landfills in counties with populations less than five hundred thousand residents from accepting deliveries of municipal solid waste after a date determined by county council resolution.  Provides exceptions for special waste or waste created as a result of a natural disaster.
