A BILL FOR AN ACT

 

 

RELATING TO AN ACCESSIBLE PLAYGROUNDS PILOT PROGRAM FOR DISABLED CHILDREN.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established a three-year accessible playgrounds pilot program to provide recreation opportunities for children of all abilities.  The pilot program shall be developed and implemented by the department of land and natural resources.  The pilot program shall:

     (1)  Create, at minimum, one accessible playground in each county on state parks;

     (2)  Obtain and consider community input before any design or construction takes place;

     (3)  Comply with all county zoning and land use regulations; and

     (4)  Be subject to the requirements of chapter 104, Hawaii Revised Statutes.

     (b)  Each accessible playground shall:

     (1)  Accommodate disabled children of all ages and their adult caregivers;

     (2)  Be designed and constructed in accordance with the Americans with Disabilities Act of 1990, P.L. 101‑336, the 2010 Americans with Disabilities Act Standards for Accessible Design, and any relevant guidelines issued by the United States Department of Justice, including but not limited to accessibility guidelines on play areas, play surfaces, play components, and access routes;

     (3)  Be constructed on an existing or new playground site; and

     (4)  Have sufficient amenities, including parking spaces and bathrooms.

     (c)  The department may partner with private entities, such as for-profit companies, nonprofit organizations, and community-based organizations to secure program funding and donations, including but not limited to donations of equipment.  The department may contract with and provide grants for counties to implement the pilot program.

     (d)  Accessible playgrounds created under the pilot program shall be completed and opened to the public no later than January 1, 2021.

     SECTION 2.  The department of land and natural resources shall submit a report on the results of the three-year accessible playgrounds pilot program, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2022.  The report shall contain, but shall not be limited to, information on playground utilization, community feedback, and operational and maintenance costs.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2018-2019 to be deposited into the state parks special fund.

     SECTION 4.  There is appropriated out of the state parks special fund the sum of $         or so much thereof as may be necessary for fiscal year 2018-2019 for the implementation of a three-year accessible playgrounds pilot program pursuant to this Act.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 5.  This Act shall effect on July 1, 2050.
