A BILL FOR AN ACT
RELATING TO THE USE OF INTOXICANTS WHILE OPERATING A VEHICLE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 291E, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:
"§291E- Operating
a vehicle with .05 or more but less than .08 grams of alcohol. (a)
It shall be unlawful for any person to operate any vehicle:
(1) With .05 or
more but less than .08 grams of alcohol per two hundred ten liters of breath;
or
(2) With .05 or
more but less than .08 grams of alcohol per one hundred milliliters or cubic
centimeters of blood.
(b) A person who violates this section shall be fined no more than $1,000."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2050.
