A BILL FOR AN ACT
relating to renewable energy.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that it is critical for the State to raise its level of energy self-sufficiency through the increased use of renewable energy. Hydrogen is a renewable fuel that can be produced from renewable feedstock using renewable energy and the capacity for hydrogen production has already been proven in concept in the State. The private sector has also expressed interest in Hawaii as a market for hydrogen fuel cell vehicles. As such, it is imperative that the State utilize public-private partnerships to produce hydrogen in Hawaii.
The purpose of this Act is to require the high technology development corporation to issue a request for proposals to establish hydrogen production facilities in the State to increase Hawaii's energy self-sufficiency.
SECTION 2. As used in this Act:
"Renewable feedstock" means feedstock that is not a fossil fuel, not derived from fossil fuel, and is not produced in conjunction with the production of fossil fuel.
"Renewable energy" means energy generated from geothermal power, hydro power, ocean thermal energy conversion, solar power, wave power, or wind power.
SECTION 3. (a) The high technology development corporation shall issue a request for proposals for one or more private entities to partner with one or more state agencies to establish a hydrogen production facility on state land in each of any two counties to utilize renewable feedstock and renewable energy to produce hydrogen as fuel for hydrogen fuel cell vehicles operated by the State in those counties.
(b) The private entity or entities shall build and shall operate the hydrogen production facilities, which shall be operational no later than December 31, 2016, at the entity's or entities' own expense.
(c) The request for proposals shall allow the private entity or entities to sell excess renewable energy not needed for hydrogen production to an appropriate electric utility and to sell any excess hydrogen not needed to supply hydrogen fuel cell vehicles operated by the State.
(d) The request for proposals shall allow the private entity or entities to lease the land for a specified period and not pay rent to the State for the use of the state land; provided that the entity or entities shall share profits from the sale of renewable energy or excess hydrogen with the State.
(e) Hydrogen fuel cell vehicles owned or operated by the State shall be allowed to access hydrogen fuel from the production facilities at no cost to the State for a period of two years from the start of operations of the production facility. Hydrogen fuel cell vehicles not owned by the State may use hydrogen fuel purchased from the production facilities.
(f) The request for proposals required by subsection (a) shall be issued pursuant to chapter 103D, Hawaii Revised Statutes, and submitted for evaluation for contract award purposes no later than December 31, 2014.
SECTION 4. This Act shall take effect upon its approval.
