A BILL FOR AN ACT
RELATING TO SCHOOL BUS SERVICES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that there is an ongoing historical bus driver shortage resulting in the elimination of nearly eighty bus routes across the State. Amid driver shortage, the department of education suspended a total of one hundred and eight routes in Central Oahu and East Hawaii Island. The suspension affected approximately 3,720 students. In response, the governor expedited the approval of an emergency proclamation to temporarily relax rules around the types of vehicles that can be used to safely transport students to and from school, and regulations around the required driver certifications. The proclamation was signed on August 2, 2024, and will expire on March 25, 2025. It is essential for the governor's emergency proclamation to be codified to allow for greater flexibility of school buses services and access for all students.
The purpose of this Act is to:
(1) Authorize the department of education to create a staggered school hours program to obtain available school bus services;
(2) Authorize the use of motorcoaches, small buses, and vans for school bus services, provided certain conditions are met;
(3) Appropriate funds to the department of education for the purchase of motorcoaches, small buses, and vans for school bus drivers; and
(4) Appropriate funds to the department of education to incentivize obtaining a commercial driver's license, to increase the number of persons eligible to become school bus drivers.
SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§302A- School bus services; staggered school hours program. The department may institute a staggered school hours program in public schools to obtain available school bus services."
SECTION 3. Section 286-102, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

(3) Passenger cars of any gross vehicle weight rating, buses designed to transport fifteen or fewer occupants, trucks and vans having a gross vehicle weight rating of eighteen thousand pounds or less, and autocycles as described in paragraph (2) of the definition of "motorcycle" in section 286-2; and
(4) All of the motor vehicles in category (3) and any vehicle that is not a commercial motor vehicle.
A school bus, small bus, motorcoach, or van operator shall be properly licensed to operate the category of vehicles that the operator operates as a school bus, small bus, motorcoach, or van and shall comply with the standards of the department of transportation as provided by rules adopted pursuant to section 286-181."
