A BILL FOR AN ACT

relating to mopeds.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 291C-202, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

"(c) The director of transportation by rules and regulations, pursuant to chapter 91, shall establish criteria and procedures for the annual safety inspection of every moped. Safety inspection criteria shall include the criteria established by the director of transportation under subsection (b). Each county shall establish and maintain an annual safety inspection of each moped that is used or intended for use on the roadways within its jurisdiction. The annual safety inspection by the county shall comply with the criteria and procedures established by the director of transportation and shall commence on January 1, 2014, or at a later date deemed necessary by the director."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to assist the counties to implement the annual safety inspection of mopeds required by section 1 of this Act.

SECTION 3. New statutory material is underscored.
