A BILL FOR AN ACT

 

 

relating to drug testing FOR WELFARE AND PUBLIC ASSISTANCE RECIPIENTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that it may be beneficial to require some recipients of public assistance to submit to drug testing in order to qualify for or to maintain eligibility for benefits.  This may help to ensure that only those who do not use illegal drugs or those willing to seek treatment are participating in public assistance programs, and that scarce public resources are going to the provision of necessities like food, utilities, and housing instead of enabling addiction. 

     The purpose of this Act to determine the costs and benefits of instituting drug testing as a requirement for public assistance programs.

     SECTION 2.  The department of human services shall undertake a study to determine the costs and benefits of instituting drug tests as a requirement for participating in public assistance programs, including the efficacy and legality of using random drug testing versus drug testing based on probable cause.  The department shall report its findings and recommendations, including recommendations for further legislative action, to the legislature not later than twenty days prior to the convening of the 2016 regular session.

     SECTION 3.  This Act shall take effect upon its approval.
