A BILL FOR AN ACT
relating to legislation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 21, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§21- Legislation; legal sufficiency. (a) No introduced bill shall be placed on the calendar for first reading in either the house of representatives or the senate unless the bill has been subject to a review by the legislative reference bureau to assess the bill's legal sufficiency, including but not limited to whether the bill:
(1) Meets constitutional requirements;
(2) Conflicts with the United States Constitution; or
(3) Conflicts with the state constitution.
(b) A copy of the bill's legal assessment by the legislative reference bureau shall be attached to each bill prior to first reading.
(c) For purposes of this section, "introduced bill" means a house bill that has been filed with the chief clerk of the house of representatives or a senate bill that has been filed with the chief clerk of the senate."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
