A BILL FOR AN ACT

 

 

RELATING TO PALLIATIVE CARE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 431:10A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§431:10A‑    Coverage for palliative care.  (a)  Each policy of accident and health or sickness insurance issued or renewed in this State shall provide coverage for palliative care to which a person is referred by a physician, osteopathic physician, or nurse practitioner; provided that this section shall not apply to accident-only, specified disease, hospital indemnity, medicare supplement, long-term care, or other limited benefit health insurance policy.

     (b)  For purposes of this section, "palliative care", as provided in the American Medical Association Self Designated Practice Specialty Definitions, means the active total care of patients when they no longer respond to curative treatments and when control of pain, symptoms, psychological, social, and spiritual problems is paramount; provided that the overall goal of palliative care is the highest possible quality of life for the patient and family offering a support system to help the patient live as actively as possible until death and a support system to help the family cope during the patient's illness and in bereavement.  Palliative care may include hospice care and  shall include medical or comfort care that reduces the severity of a disease or slows its progress rather than providing a cure, and care provided in conjunction with curative treatments.  Palliative care shall include care provided by a variety of licensed providers, including physicians, nurses, social workers, nutritionists, naturopathic physicians, pharmacists, massage therapists, respiratory therapists, physical therapists, occupational therapists, psychologists, and other licensed providers. 

     (c)  Coverage for palliative care under this section shall be provided to a covered person who is diagnosed with a chronic or serious disease."

     SECTION 2.  Chapter 432:1, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§432:1‑    Coverage for palliative care.  (a)  Each policy of accident and health or sickness insurance issued or renewed in this State shall provide coverage for palliative care to which a person is referred by a physician, osteopathic physician, or nurse practitioner; provided that this section shall not apply to accident-only, specified disease, hospital indemnity, medicare supplement, long-term care, or other limited benefit health insurance policy.

     SECTION 4.  Section 432D-23, Hawaii Revised Statutes, is amended to read as follows:

     "§432D-23  Required provisions and benefits.  Notwithstanding any provision of law to the contrary, each policy, contract, plan, or agreement issued in the State after January 1, 1995, by health maintenance organizations pursuant to this chapter, shall include benefits provided in sections 431:10-212, 431:10A-115, 431:10A-115.5, 431:10A-116, 431:10A-116.5, 431:10A-116.6, 431:10A-119, 431:10A-120, 431:10A-121, 431:10A-125, 431:10A-126, [and] 431:10A-122, and 431:10A- , and chapter 431M."

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.   

     SECTION 6.  This Act shall take effect on July 1, 2011.
