A BILL FOR AN ACT


 

 

relating to the hawaii export center.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 201, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§201-    Hawaii export center; established; location; purpose; rules.  (a)  There shall be established the Hawaii export center within the department of business, economic development, and tourism.

     (b)  The Hawaii export center shall be located on state land within the Kalaeloa community development district pursuant to section 206E-193.

     (c)  It shall be the purpose of the Hawaii export center to facilitate and expedite the export of products of small export businesses in the State by managing and coordinating the efficient sharing of shipping containers for multiple small export businesses.  The Hawaii export center shall be the locus of export shipping facilities targeted to serve small export businesses in the State who do not have large enough quantities of product to completely fill one standard shipping container for export at any one time.

     (d)  The department of business, economic development, and tourism shall contract with a private entity to manage the operations of the Hawaii export center.  The department shall adopt rules in accordance with chapter 91 to establish a process for a private entity to bid for and be awarded a contract to manage the operations of the Hawaii export center and shall include provisions for leases, maintenance, and fulfillment for exporters."

     SECTION 2.  Chapter 206E, Hawaii Revised Statutes, is amended by adding a new section to part VII to be appropriately designated and to read as follows:

     "§206E-    Hawaii export center; jurisdiction.  Notwithstanding this part or any other law to the contrary, the department of business, economic development, and tourism shall have exclusive jurisdiction over the management and operation of the Hawaii export center located within the Kalaeloa community develop district pursuant to section 201-  ."

     SECTION 3.  The department of business, economic development, and tourism shall submit a written report to the legislature no later than twenty days prior to the convening of the regular session of 2010 that shall include a proposed capital improvement project and a proposed operational budget for the Hawaii export center.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
