A BILL FOR AN ACT

 

 

relating to prisoner release.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 353, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§353-     Early release prohibited; exceptions.  (a)  A committed person confined in a state correctional facility in execution of a sentence imposed upon the committed person shall not be released prior to completion of the committed person's sentence except as provided by part II of this chapter or by reason of the committed person's terminal illness.

     (b)  For purposes of this section, "terminal illness" means a progressive and incurable medical condition that is expected to result in death."

     SECTION 2.  New statutory material is underscored.     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 4.  This Act shall take effect upon its approval.
