A BILL FOR AN ACT


 

 

relating to land use commission.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that while all lands in the city and county of Honolulu that are designated conservation under chapter 205, Hawaii Revised Statutes, are zoned restricted preservation zone, P-1, there are a number of parcels, including but not limited to open spaces at Mau‘uwai and Queen's Rise, in the city and county of Honolulu that are zoned general preservation zone, P-2, but are designated urban, rather than conservation, under chapter 205, Hawaii Revised Statutes.

     The purpose of this Act is to direct the office of planning to file a petition with the land use commission to reclassify all lands within the city and county of Honolulu that are zoned P-2 into the conservation district.

     SECTION 2.  The office of planning is directed to initiate a land use boundary amendment reclassifying all lands with the city and county of Honolulu that are zoned general preservation zone, P-2, and classified in the urban district into the conservation district.

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before January 1, 2009.

     SECTION 4.  This Act shall take effect upon its approval.
