HOUSE CONCURRENT

RESOLUTION

 

 

requesting the department of public safety and the department of hawaiian home lands to establish a task force to consider whether the two departments should enter into a memorandum of understanding to have the department of hawaiian home lands administer and operate a community-based program for offenders on HAWAII island.

 

 

 


     WHEREAS, under the comprehensive offender reentry system, the Department of Public Safety is authorized to purchase service contracts for adult offender reentry programs and services that establish or improve the offender reentry system and in which each adult offender in state correctional custody is provided an individualized reentry plan; and

 

     WHEREAS, among the programs and services that may be offered by the Department of Public Safety, are community-based programs, which, unlike institution-based programs, reentry programs, or reintegration programs, are programs that are administered and operated outside of a correctional facility; and

 

     WHEREAS, generally, community-based programs are administered and operated by community agencies, faith-based organizations, non-profit organizations, and other similar entities, as opposed to state or other government agencies; and

 

     WHEREAS, an alternative to the purchase of service contracts with community agencies and similar entities would be a memorandum of understanding with the Department of Hawaiian Home Lands, for the administration and operation of a community-based program; and

 

     WHEREAS, the Land Management Division of the Department of Hawaiian Home Lands is the division responsible for the management of the Department's lands that are not homestead lands, and are not required to be used only for homestead purposes, but may be used for other department operations; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the Senate concurring, that the Department of Public Safety and the Department of Hawaiian Home Lands are requested to establish a task force to consider whether the two departments should enter into a memorandum of understanding to have the Department of Hawaiian Home Lands administer and operate a community-based re-entry program for offenders on Hawaii Island; and

 

     BE IT FURTHER RESOLVED that the Director of Public Safety and the Chairperson of the Hawaiian Homes Commission are requested to serve as co-chairpersons of the task force and to select the other members of the task force at their discretion so as to have all interested stakeholders represented; and

 

     BE IT FURTHER RESOLVED that the Director of Public Safety and the Chairperson of the Hawaiian Homes Commission are requested to submit a report of the task force's findings and recommendations, including any proposed legislation, to the Legislature not later than twenty days prior to the convening of the Regular Session of 2012; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Public Safety and the Chairperson of the Hawaiian Homes Commission.
