HOUSE CONCURRENT

RESOLUTION

 

 

requesting the State auditor to conduct a comprehensive audit of the contractors license board.

 

 

 


     WHEREAS, Hawaii's contractor licensing law, codified as chapter 444, Hawaii Revised Statutes, is a consumer protection statute intended to protect the public's health, safety, and welfare when dealing with persons engaged in the construction industry, and therefore requires a licensee to show experience for each license obtained; and

 

     WHEREAS, the Contractors License Board is the governing board for contractors licensed in Hawaii; and

 

     WHEREAS, the Contractors License Board has been audited by the State Auditor in 1983, reported in 83-3 Sunset Evaluation Report, Contractors, Chapter 444, Hawaii Revised Statutes (1983 Audit), and in 1989, reported in 89-3 Sunset Evaluation Update, Contractors, Chapter 444, Hawaii Revised Statutes (1989 Audit); and

 

     WHEREAS, it is unclear if the Contractors License Board has implemented any of the findings of either the 1983 Audit or the 1989 Audit; and

 

     WHEREAS, the Contractors License Board reviewed the criteria, requirements, and procedures for general engineering contractor licenses, general building contractor licenses, and specialty licenses in 2013 in response to Senate Concurrent Resolution No. 84, 2013, in the report entitled Report of the Contractors License Board, November 2013 (November 2013 Report); and

 

     WHEREAS, the Contractors License Board has failed to act on any of its proposed recommendations through the rulemaking process since the report was submitted to the Legislature in November of 2013; and

 

     WHEREAS, an audit of the Contractors License Board is necessary to instill greater confidence in the public that the Contractors License Board is doing its utmost to protect the public's health, safety, and welfare; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the Senate concurring, that the State Auditor is requested to conduct a comprehensive audit of the Contractors License Board; and

 

     BE IT FURTHER RESOLVED that the audit include, but not be limited to:

 

     (1)  The general operations of the Contractors License Board;

 

     (2)  The organizational structure of the Contractors License Board including personnel practices and staffing coverage;

 

     (3)  Internal budgeting and fiscal controls;

 

     (4)  The status of the implementation of the findings of the 1983 Audit;

 

     (5)  The status of the implementation of the findings of the 1989 Audit;

 

     (6)  The status of the implementation of the recommendations of the November 2013 Report; and

 

     (7)  Any other matters the State Auditor deems appropriate; and

 

     BE IT FURTHER RESOLVED that the State Auditor is requested to submit findings and recommendations to the Legislature, including any proposed legislation, no later than twenty days prior to the convening of the Regular Session of 2020; and

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor, Chairperson of the Contractors License Board, Licensing Administrator of the Professional and Vocational Licensing Division of the Department of Commerce and Consumer Affairs, and the Director of Commerce and Consumer Affairs.
